PROMOTION AND SPONSOR: The Field2Base #GoPaperless Sweepstakes (the “Sweepstakes”) is sponsored by Field2Base, Inc. (“Sponsor”) and begins at 12:00:00 am Eastern Time (ET) on January 3, 2018 and ends at 11:59:59 pm ET on February 28, 2018 (the “Promotion Period”).   

HOW TO ENTER:  Visit field2base.com (“Website”) during the Promotion Period and click on the #GoPaperless Sweepstakes icon and follow the online instructions to respond to several survey questions and the official entry form with your first and last name, email address, phone number, age and company name. Then confirm your agreement to the Sweepstakes Official Rules by clicking where indicated, then click the “Submit” button and you will receive one (1) entry into the sweepstakes drawing. If you are an employee, officer or director of a company, be sure to obtain any required permissions from appropriate supervisory personnel at your company before entering the Sweepstakes. LIMIT ONE (1) ENTRY, PER PERSON AND EMAIL ADDRESS.

Date and time of entry for determination of eligibility and compliance with these Official Rules shall be determined solely by the computer clock of the Sponsor’s administrator which is the official timekeeper of this Sweepstakes. 

If using a mobile device to enter the Sweepstakes, you understand and agree that wireless Internet access charges and/or other fees may apply. You are advised to review your wireless carrier’s rate plan before entering the Sweepstakes via mobile device. Wireless Internet access is not available on all mobile devices and may not be available in all areas.

Multiple entrants are not permitted to share the same email address. Use of any robotic, automated, programmed, or similar system or third-party entry services to participate is prohibited and will result in disqualification. In the event of a dispute as to ownership of the entry, the entry will be deemed made by the person named on the entry form. Only one person may use a given email address to enter. Should Sponsor acknowledge receipt of an entry, such action does not (a) constitute any representation by Sponsor of eligibility of entry; (b) constitute a notice of selection of entry as the potential winner in the Sweepstakes; or (c) in any way increase the applicable entrant's odds of winning the prize in the Sweepstakes. No other method of entry aside from that described above will be eligible.

Any entries deemed by Sponsor, in its sole discretion, to not be in compliance with any of the entry requirements and restrictions set forth herein will not be eligible to win the prize in the Sweepstakes. By submitting an entry, entrant represents that he or she has complied with all of these Official Rules. No correspondence regarding entries will be entered into with entrants except as provided herein. Entries not complying with these Official Rules are subject to disqualification. By participating in the Sweepstakes, entrants agree to be bound by these Official Rules and the decisions of the Sponsor and it agents including independent judging organizations, which shall be final and binding in all matters relating to this Sweepstakes. No other method of participation will be accepted or acknowledged.

ELIGIBILITY: The Sweepstakes is open only to legal residents of the 50 United States and the District of Columbia who are at least 18 years of age or older at the time of entry. Employees, officers and directors of Field2Base, Inc. (“Sponsor”), its parent company, related entities, subsidiaries and affiliated companies, advertising, promotion, or production agencies (including the independent judging organization), prize suppliers, or any companies who are promotional participants (collectively the “Released Parties”)  as well as each of their immediate family members defined as spouses, (biological, adoptive or step-) parents, siblings, children and each of their respective spouses (regardless of where they reside) and household members of each such employee/officer/director (whether related or not) are not eligible to enter or win the prize. The Sweepstakes is void outside of the 50 United States/DC and where prohibited.

RANDOM DRAWING/ODDS:  On or about March 6, 2018, a random drawing to select one (1) Potential Prize Winner will be conducted from among all eligible entries received. Answers to the survey questions will not be taken into consideration to determine eligibility for or selection in the random drawing; however, in order to constitute an eligible entry, all survey questions must be answered truthfully and to the best of one’s knowledge and belief. Sponsor’s independent judging organization, whose decisions along with those of the Sponsor are final and binding in all matters relating to the drawing, will conduct the drawing. Odds of winning the prize depend on the number of eligible entries received. 

PRIZE:  One (1) Prize (a “Prize”) will be awarded consisting of a Samsung Galaxy Tab® S3 9.7”, 32GB, Wi-Fi enabled tablet computer with Android™ operating system and S Pen Stylus*. The Approximate Retail Value (“ARV”) of the Prize is $599.99.   

*Referenced trademarks are the property of their respective owners and are used herein solely for purposes of prize description. No endorsement, authorization or sponsorship is intended or implied by such use. The Prize will be awarded provided the prize is properly claimed. The Winner is solely responsible for all applicable taxes, insurance and other expenses which may be required for the enjoyment and use of the Prize; this includes but is not limited to wireless Internet access charges and any accessories (for example, keyboard cover). Prize must be accepted as awarded. If winner is an employee, officer or director of a company, the prize is awarded subject to the written policies of such company as to its employees/officers/directors’ receipt of gifts/prizes/awards from third party entities. Prize is non-transferable, and no Prize substitution or cash redemption is allowed except by Sponsor in its sole discretion, or as otherwise provided herein. Sponsor may substitute a Prize of equal or greater value if the advertised Prize becomes unavailable for any reason, as determined by Sponsor in its sole discretion. Prize is subject to the manufacturer’s warranty and/or terms and conditions. The ARV of the Prize is subject to price fluctuations in the consumer marketplace based on, among other things, any gap in time between the date the ARV is estimated for purposes of these Official Rules and the date the Prize is awarded or redeemed; and, winner will not receive the difference in cash or otherwise should the ARV exceed the actual value of the Prize. The Prize will be fulfilled within approximately six weeks after Winner verification and such Prize will not be fulfilled outside the 50 United States/DC and the Prize will only be shipped to a street address in the 50 United States/DC.

The potential prize Winner will be notified by Sponsor via the email address indicated on the entry form within three (3) business days of the drawing date. The Potential Prize Winner will be required to sign and return an Affidavit of Eligibility, Liability and Publicity Release (where lawful), which must be received by Sponsor within five (5) business days of the date notice or attempted notice is sent, in order to claim the prize.  If the potential prize Winner cannot be contacted for any reason, or fails to sign and return the Affidavit of Eligibility, Liability and Publicity Release or provide any other requested information within the required time period, the potential prize Winner forfeits their prize. In the event that a potential prize Winner is disqualified for any reason, Sponsor will award the applicable Prize to an alternate Winner in a random drawing from among all remaining eligible entries received for the drawing.

If Sponsor so elects, the potential prize Winner may be required to submit to a confidential background check to confirm eligibility and help ensure that the use of any such person in advertising or publicity for the Sweepstakes will not bring Sponsor into public disrepute, contempt, scandal or ridicule, or reflect unfavorably on the Sweepstakes as determined by Sponsor in its sole discretion; and, potential prize Winner agrees to cooperate fully with Sponsor and its agencies relative to the performance of such background check (including but not limited to providing any and all necessary consents) and to be bound by its results which are final and binding and not subject to appeal. 

GENERAL CONDITIONS:  Except where prohibited by law, participation in the Sweepstakes constitutes permission for Sponsor and its designees to use the entrant’s name and city/state, and other non-confidential information for promotional, advertising and marketing purposes in any media now known or hereafter devised throughout the world without prize, incentive, compensation, consideration, consent or review without limitation and without further notice or approval. Also, a Winner’s first name and last name initial and associated city/state of residence may be posted on the Sponsor’s website and may be announced by news release without prior notice or approval of the Winner or compensation to the Winner other than the Prize.

By accepting the prize, the Winner acknowledges that his/her receipt and use of the prize is voluntary; acknowledges that there are natural factors and occurrences that may impact or affect their safety and he/she assumes all risk of such factors and occurrences and agrees that the Sponsor and its agencies shall not be in any way responsible for any resulting injury and/or death or property damage.

Sponsor and its agencies are not responsible for entries that are lost, late, illegible/garbled, corrupted, misdirected, defective, inaccessible, compromised, incomplete, damaged or delayed and all such entries are void, including those caused by some defect or operation of computers/devices (including but not limited to any website). Sponsor and its agencies are also not responsible for (1) any incomplete, incorrect or inaccurate information, whether caused by tampering, hacking, equipment malfunction/failure or other cause; (2) any error, omission, interruption, deletion, defect, delay in operation or transmission of entries, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries; or (3) any problems or technical malfunctions, disruptions or failures of any kind, including, telephone network or lines, computer on-line-systems, servers or providers, software or programming or for damage to one’s computer or mobile device (or any data stored thereon) due to participation in the Sweepstakes.  Proof of submitting an entry will not be deemed to be proof of receipt by Sponsor.  Sponsor and its agencies are also not responsible for lost, late, incomplete, invalid, unintelligible, illegible, or misdirected entries which will be disqualified.

Any person attempting to defraud or in any way tamper with the Sweepstakes may be prosecuted to the fullest extent of the law; and, if the Sponsor and/or the independent judging organization determine that the entrant was involved in such attempt in any way, the entrant will be disqualified. (But, in such case, disqualification shall not represent the sole remedy available to Sponsor and/or the independent judging organization; and, Sponsor and/or the independent judging organization each expressly reserve the right to take appropriate actions so as to protect their respective legal rights.) Sponsor reserves the right to cancel, suspend and/or modify the Sweepstakes, or any part of it, if any fraud, technical failures or any other factor beyond Sponsor’s reasonable control impairs the integrity or proper functioning of the Sweepstakes (including but not limited to the functioning of any website), as determined by Sponsor in its sole discretion. In such event, Sponsor will determine the prize Winner and make the Prize available for those entries that were qualified and accepted by Sponsor up to the time of cancellation, termination or suspension consistent with these Official Rules. Notice of such action by Sponsor will be posted on the Sponsor’s website, www.field2base.com. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.

By participating in the Sweepstakes entrant (a) agrees to totally and completely release, discharge, defend and indemnify Sponsor and the other Released Parties and each of their respective officers, directors, employees, and agents from any and all liability for any loss, harm, damages, costs or expenses, including without limitation property damages, personal injury (including without limitation emotional distress) and/or death to any person arising out of participating in the Sweepstakes, or the acceptance, possession, use or misuse of the prize, and claims based on violation of rights, regardless of whether any claim(s) for loss or damage under this paragraph, or knowledge of the facts constituting such claim(s), exist at the time of participation in the Sweepstakes or arise at any time thereafter; (b) acknowledge and agree that Sponsor and the other Released Parties have neither made nor are responsible or liable for any warranty, representation, or guarantee, express or implied, oral or written, in fact or in law, relative to the prize including but not limited to its quality, mechanical condition, or fitness for a particular purpose and, (c) agree to fully comply with these Official Rules.

DISPUTES:  Entrants agree that (1) any and all disputes, claims, and causes of action arising out of, or connected with, this Sweepstakes including without limitation, any alleged violation of these Official Rules, any controversy relating to the arbitrability of any dispute, or any claim that these Official Rules (or any part thereof) are invalid, illegal, or otherwise voidable (or void) shall be resolved individually, without resort to any form of class action, and exclusively by arbitration to be held solely in the State of North Carolina; (2) any and all claims, judgments, liabilities, and/or awards shall be limited to actual out-of-pocket costs incurred (if any), including costs associated with participation in this Sweepstakes or otherwise accessing this Sweepstakes, but in no event attorneys’ fees; and (3) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives, all rights to claim, punitive, special, incidental, and/or consequential damages and any other damages, other than out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. IN AGREEING TO RESOLVE ANY DISPUTE VIA ARBITRATION, ENTRANT UNDERSTANDS AND AGREES THAT HE/SHE IS WAIVING HIS/HER RIGHT TO SUE IN COURT AND HAVE A JURY TRIAL.  SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO A GIVEN ENTRANT. Judgment upon the arbitration award may be entered in any court having competent jurisdiction thereof. This arbitration provision shall be deemed to be self-executing, and in the event that either party fails to appear at any properly noticed arbitration proceeding, an award may be entered against such party notwithstanding said failure to appear. In no event shall entrant seek or be entitled to rescission, injunctive, or other equitable relief or to enjoin or restrain the operation of this Sweepstakes, exploitation of any advertising or other materials issued in connection therewith, or exploitation of this Sweepstakes or any content or other material used or displayed on this Sweepstakes. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of the State of North Carolina without giving effect to any choice of law or conflict of law rules (whether of the State of North Carolina or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of North Carolina.

Sponsor will collect personal data about entrants when they enter the Sweepstakes. The entrant’s personal information may be used by the Sponsor for internal purposes, and may further be disclosed to and used for administrative, promotional and marketing purposes.
